1.0 Introduction

The Bet5Games websites and services are owned and operated by AE Ltd. (AE), registered in the Commonwealth of Bahamas under Company No. 200850 B, with its registered headquarters at 1st Floor, Building A, Caves Corporate Center, Blake road & West Bay Street, Nassau, Bahamas.

AE provides online real money gambling (RMG) experiences, hosted on the Bet5games.com website. AE offers pool-based and direct betting experiences. People under 18 years of age are not permitted to play AE games or those who do not meet the legal age requirement for playing our games in the country in which you live. Internet Gambling may be illegal in the jurisdiction where you are located. If so, you are not authorized to participate in RMG services on any AE platform or website. A prize won by a player under the approved age will be forfeited.


2.0 Terms of Use

These Terms and Conditions (T&C) along with our Privacy Policy, together referred to as the “Terms” form the basis upon which we offer our games and services. When you register an account with us you will be asked to confirm that you accept these terms. After depositing funds into a new account, AE, using an accredited ID verification program, will request ID verification. This may be done as soon as reasonably practicable following the deposit of funds into a new account, but before any withdrawal is made. Verification of identity will be undertaken using reliable, independent source documents such as passport, driving license, data or information.

By using AE games which are available on a website, you confirm that you have read and agree to comply with these Terms. If you do not agree to these Terms, you must not use any of AE’s games and services. We recommend you print a copy of these T&Cs, associated policies, and any financial transactions you make for your own records and future recall.

Our Privacy Policy explains how we use your personal information and can be found on our website. If at any time you do not agree with our T&C or our Privacy Policy, you should stop using our services immediately and contact us to close your account. Your continued use of our website, products or services will entitle us to assume acceptance.

3.0 Changes to Terms, Games, and Website(s)

3.1 Terms and Conditions (T&C)

AE demonstrates compliance to ensure gambling is provided fairly. In line with our requirements AE reserves the right to make changes to any policies, Competition Rules, Game Rules, player requirements, Complaints Procedure, and T&C at any time. AE will notify you of material changes to T&C via email and/or through the website. Every time you wish to access the games on AE websites, the most up-to-date version of the T&C will be displayed; you are responsible for checking the T&C to ensure you understand them. By continuing to use AE’s website(s), you confirm your acceptance of the current version of the T&C.

3.2 Games on AE Website(s)

AE may update the games and/or supporting features on the website(s) to reflect changes to our services, players’ needs, legal requirements, and our business priorities. AE reserves the right to stop offering games on the AE website(s) at any time. Should this happen, unless applicable law requires otherwise, you will not be entitled to any compensation.


4.0 Your Account

Before being able to play our games or use our services you must register an account with us by completing the Registration (Sign-up) form on our website. You must be 18 years of age or older, or meet the legal age requirement for playing our games in the country you live in. It is your responsibility to check that it is legal for you to access our games, products or services from the country in which you are trying to access them. Your account must be in your own name and using your up to date personal and contact information and for your sole benefit. If any of your personal information changes at any time you can make changes on your player profile.

You may only hold one active account with us. We reserve the right to close any other account(s) that we believe or suspect to be linked or associated with you. If you suspect or believe that someone may have access to your account or user information, you should cease to use our services and contact us immediately. If we believe or have reason to suspect that there has been a breach of any of our Terms, we reserve the right to suspend or restrict your access pending further investigation. A person must not participate under a name, account name or designation that is obscene, indecent or offensive.

4.1 Closing Your Account

You can choose to close your account with us at any time by contacting us at: support@bet5games.com. There may be occasions when we decide to close your account because we are unable to continue to offer you access to our games, products, or services. On such occasions we will contact you using the contact information you have provided us to notify you of this. Any funds will be managed in accordance with our Inactive Accounts policy.

4.2 Inactive Accounts

If you have not used your account for a continuous period of 12 months, we will consider it to be inactive. We will attempt to contact you using the contact information you have provided us to advise you of this. If we do not receive a response from you within 60 days, your account will be closed, and any remaining funds forfeited.


5.0 Conditions of Using AE Services

AE may assess individual eligibility for participation in its games via website(s), in accordance with requirements for age and identity verification. As a player on AE Games, you understand and acknowledge:

  • You are 18 years old or over or meet the legal age requirement for playing our games in the country you live in.
  • It is your responsibility to check that it is legal for you to access our game, products or services from the country you are accessing our game from.
  • You have provided AE with valid, accurate, and complete personal details (including your name and address). Your account must be in your name and using up to date personal and contact information and for your sole benefit.
  • You will keep your personal data up to date should any details change.
  • You may only hold one active account with us. We reserve the right to close any other account(s) that we believe or suspect to be linked or associated with you.
  • If you believe or suspect that someone may have access to your account or user information, you should cease to use our services and contact us immediately.
  • If we believe or have reason to suspect that there has been a breach of any of our Terms, we reserve the right to suspend or restrict your access pending further investigation.

By participating in AE RMG services, you acknowledge you are gambling lawfully within your country of residence that governs your jurisdiction.

To participate in the AE RMG, you acknowledge:

  • The use of your personal information, specifically your name, general location, and likeness, will be used by AE to identify you within the platform and report your performance on our leader boards. If you do not want your name to be displayed, you should contact us as instructed in our Privacy Policy.
  • You will receive no compensation for the use of your name and/or likeness on the website, in association with the games being played, and/or the leader boards.

6.0 AE Discretion

AE reserves the right, at any time, to:

  • Refuse a request to open a user account.
  • Terminate or suspend your user account, your participation in any competition, or your access to any games if you breach, or we have reasonable suspicion you have breached any AE T&C, Competition Rules, Player Rules, or any other policies.
  • Submit your personal data for a check to a third-party service provider to perform AntiMoney Laundering (AML) and Know Your Customer (KYC) in compliance with our obligations under applicable laws to prevent fraud, money laundering, and terrorism funding activities and to comply with social responsibility measures.
  • Verify your account information by requesting additional documentation such as valid photographic identification (ID) and/or proof of address (dated within the last 3 months)
  • Verify your age to ensure you are aged 18 or over, using your documentation and/or thirdparty service providers.
  • Suspend or terminate your access if you fail to comply with KYC data verification requests, if your account has been inactive for more than twelve months, or if we believe you have been using your account fraudulently, criminally, or in breach of these Terms.
  • Investigate your activity in response to customer complaints, suspected money laundering, collusion, cheating, and/or problem or underage gambling, and/or
  • Where necessary make a report on our website(s) to local law enforcement, or other governing bodies.

Any collection of personal data involved in the above activities will be carried out in accordance with our Privacy Policy.


7.0 Keeping Your Account Details Safe

You must treat all data associated with your player account (e.g., your User ID and password) and any personal data (e.g., answers to security questions) as confidential, and not disclose it to any third party. AE reserves the right to disable any User ID or password at any time if it has a reasonable suspicion that a player has failed to comply with any provisions of the Terms. If you know or suspect that anyone other than you acquire your User ID and password, you should change it and promptly notify AE customer service at: support@bet5games.com


8.0 Protection of Client Funds

We hold a segregated bank account in which we maintain, on a monthly basis, sufficient funds to promptly pay out withdrawal requests based on our players’ cash balances. Additionally, there are several controls over this bank account to further mitigate the risk associated with depositing funds with us: there are no set off arrangements on this account and the account is reconciled by the AE finance team on a monthly basis.


9.0 Withdrawal Policy

AE Ltd is serious about keeping money laundering out of our games. The simplest method of laundering money is having two or more people making opposite bets with a low house edge at the same time. There are endless variations of these approaches. Accordingly, to ensure that AE games are not contaminated by money laundering schemes, AE requires that all deposits and deposit match bonuses be played sixty (60) times the deposit amount before a withdrawal may be made. Also, all depositors are required to verify their identities and pass an independent money laundering review by an independent organization specializing in this topic any time prior to withdrawal.

AE RMG contests start and end about every 6 minutes. Unlike traditional Baccarat, AE games offer 5 Player-Bank Matchups, with up to 5 rounds of betting allowed on each of the 5 matchups. In other words, this minimum play requirement may easily be accomplished in a very short period of time.


10.0 AE Intellectual Property (IP) Rights

AE owns or is licensed to use all IP rights associated with its website(s), games, and competitions, to include copyrights, trademarks, underlying software, game design, graphics, layouts, domain names, look and feel, user interfaces, and structures. By using AE services, players do not acquire any access or claim to associated IP rights, and unauthorized use of AE websites, games, or competitions may give rise to a claim for damages, injunction, and legal costs and/or be a criminally prosecutable offense.

Use of the AE services is for your own non-commercial entertainment purposes, and you agree not to use the AE services for any other purpose and agree that AE will have no liability to you for damage or loss arising from unauthorized use.

You acknowledge that AE may use personal data you provided, including your name, city of residence, and photograph(s), for products and services associated with AE games (e.g., performance and status leaderboards) and that AE will protect this data in accordance with our Privacy Policy.


11.0 Payment Methods

You may use any of the payment methods we accept to purchase game credits and bet which include credit cards; (b) debit cards or stored value accounts; and (c) any other methods offered. Cash is not accepted. You may only use a payment method that belongs to you and has been issued to you in your name. In the case of mobile carrier billing, you may only use a mobile account which belongs to you and where you are the billpayer.

Credits will be added to your player account after the payment provider has approved the payment request. Where we have reason to suspect or believe that a payment method being used does not belong to you, we reserve the right to suspend your account pending further checks.

We reserve the right to defend a chargeback, reversal of transaction or not honor notice received after the payment has been approved and funds added to your account. Where we receive such notice your account with us will be suspended pending investigation. Where fraudulent action is suspected or has taken place, we reserve the right to withhold funds whilst investigations are conducted.


12.0 Responsible Gambling

If you feel you are experiencing gambling harm, please stop playing and notify AE customer service at support@bet5games.com and/or visit your jurisdictions safe gambling site.

Those who have acknowledged that their gaming activities have become a problem and who wish to permanently exclude themselves from participating in further gaming activities may do so by submitting a request to AE customer service at support@bet5games.com

After voluntary self-exclusion is effective, you are prohibited from accessing, opening an account, depositing/withdrawing funds or playing on all Bet5Game sites.

AE advocates responsible use of our websites, games, and competitions. AE shall not be held liable for losses a player incurs due to excessive or irresponsible activity on any of the AE websites, games, or competitions.


13.0 Game Rules

It is your responsibility to ensure that you have read and understand the How to Play before you start playing. We reserve the right to suspend your participation in a game or entitlement to any funds if we believe or suspect that you have breached the games rules or our Terms in relation to your account or the proper use of our services. We reserve the right to make changes to our games, products or services at any time and without notice.


14.0 Limitations of AE Liability

14.1 External Websites

AE will continuously make efforts to verify the functionality of links to other sites with data and resources provided by third parties; however, AE has no control over the content of those sites or resources and excludes any and all liability in respect of them and does not promote the use of the associated data or resources.

14.2 AE Website Use

AE websites are for domestic and private use, and players agree not to use our services for any commercial or business purposes. AE has no liability to any users for any financial loss, business loss, business interruption, or loss of business opportunity.

AE is not liable for the negligent breach of obligations, whose fulfillment is essential to enable the ordinary implementation of the contract, whose breach jeopardizes the achievement of the purpose of the contract and on whose compliance you as a customer may rely on regularly. In the last-mentioned case, AE is only liable for foreseeable, typical contractual damage.

AE is not liable for slight negligent breach of other obligations than those mentioned in the above sentences. The abovementioned exclusions of liability do not apply in case of damage of life, body, and health.

The liability pursuant to the product liability law or any other cases of mandatory legal liability remains unaffected.

AE makes no guarantee that if a player loses connectivity, closes a browser, or navigates away from a game for any reason that the player will be able to rejoin any active contest the player may have joined and/or been participating in. Any bets made in relation to contests will still be scored, but players may not be able to rejoin and continue making predictions if they navigate away from the active contest.

Odds in the app or on the website reflect real time events. It is possible that odds change reflecting an event in real time that the user does not immediately see in a telecast due to broadcast delays. For time-critical events, players might be at a disadvantage because of technical issues such as slower network speeds, or slower end user device performance. Based on the current state of art, data communication via internet cannot be guaranteed to be error-free and/or available at any time. AE is not liable for constant and continuous availability of its online system. Players may be at a disadvantage when placing in-game on-line selections compared with people at a live event who may have real-time updates to the action.

14.3 Service Interruptions Caused by Player Connectivity Issues

AE assumes no responsibility for service interruptions created by a poor data connection, limited bandwidth, or other data flow disruption between the AE servers and the player’s end point device(s).


15.0 Wager Limitations and Service Interruptions

Where unexpected system flaws, faults, or errors that affect players occur, steps will be taken as soon as practical to remedy the problem and ensure players are treated fairly according to the circumstances. In the event of an unrecoverable malfunction of system hardware or software, AE will make every effort to honor accepted wagers and promptly restore the website(s), game(s), and/or competition(s) impacted. Any wagers submitted, but not formally accepted by the system, will be refunded to a player’s account.


16.0 Currency, Player Wallets, and Taxes

Players will be able to access the last three months of financial transactions and wagers through AE’s platform, and records for the previous twelve months are available upon email request to AE Customer Support: support@bet5games.com.

All AE Real Money Contests may be funded using approved local currencies, which will be converted to U.S. dollars at the published exchange rate at the time of the transaction request. Withdrawals will be processed in the original currency at the published exchange rate at the time of the withdrawal. Players will be presented and must approve the conversion rates at the time of the deposit/withdrawal request for the transaction to be completed.

Additional considerations regarding player funds include:

  • Funds in player wallets will be displayed in US dollars.
  • Player deposits will be converted by our third-party payment providers and conversion rates will be displayed on the screen at the time deposits are made.
  • Prize money is rounded up to the next cent. For example, if the percentage calculation of a prize results in $29.311, the actual prize will be $29.32.

It is the sole responsibility of the Player to pay and comply with all applicable laws regarding taxes on any winnings or prize(s) in their respective jurisdiction.


17.0 Use of Your Personal Information

AE will only use your personal data as set forth in our Privacy Policy.


18.0 Complaint Procedure

AE strives to offer our players optimal services of the highest standards at all times. To address any time a player is dissatisfied with AE conduct, AE has established internal procedures for handling complaints fairly and promptly.

If you are unhappy with our services or would like to raise a complaint about any aspect of our game, product or services, you may do so by contacting Customer Support at support@bet5games.com.

It is our policy to resolve complaints raised as quickly as we can, although some issues may take a little longer than others depending on the nature of the complaint, and whether we need to contact external partners such as payment providers. We will however try to resolve your complaint within eight (8) weeks. To assist us, we will need to provide information about your complaint/dispute, including dates, times and any amounts.

Once the review of the complaint/dispute is complete, we will share with you the result of our investigation and next steps.


19.0 Additional Considerations

19.1 Severability

If any part of these Terms is deemed invalid, unlawful, void, or for any reason unenforceable, that section shall be deemed severable from the rest of the Terms and shall not impact the validity and enforceability of the remaining provisions.

19.2 Entire Agreement

These Terms constitute the entire agreement between AE and the player and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations, and understandings between them, whether written or oral.

19.3 Governing Laws and Jurisdiction

These Terms shall be governed by, and construed in accordance with the law of the Commonwealth of the Bahamas and any dispute shall be resolved under the exclusive jurisdiction of the courts of the Commonwealth of the Bahamas. The preceding clause shall not apply if the choice of law and/or the place of jurisdiction conflicts with mandatory consumer protection regulations of the jurisdiction in which the player is located.

19.4 Errors, Interruptions and Malfunctions

In order to play you will need to be connected to the internet. We accept no responsibility for any loss as a result of any interruption or loss of connection to our games, products or services. In the event that there is an error, interruption, or malfunction (technical or palpable) that we are unable to rectify, games and or plays will be made void.

19.5 Limitation of Liability

We do not accept any responsibility or liability for any losses or damage to equipment incurred by you as a result of the use of our games, products or services, or as a result of a breach of our Terms.
